Contact Lens Search Advertising Lawsuit

Case Summary

The law firms Robbins Geller Rudman & Dowd LLP and Boies Schiller Flexner LLP have been appointed as Interim Co-Lead Class Counsel in a consolidated class action lawsuit brought on behalf of consumers who purchased contact lenses from certain sellers online. J.Thompson, et al. v. 1-800 Contacts, Inc., et al., Case No. 2:16-cv-01183 (D. Utah).

Plaintiffs allege that 1-800 Contacts and at least 14 other online contact lens retailers entered into a series of unlawful agreements through which they agreed not to compete with each other in certain online advertising, thereby suppressing competition and inflating the amount consumers paid for contact lenses. Our investigation reveals that the earliest agreement dates back to 2004.
