Overview

Joseph Russello is a partner in Robbins Geller Rudman & Dowd LLP’s Melville office, where he concentrates his practice on prosecuting shareholder class action securities and breach of fiduciary duty claims, as well as complex commercial litigation and consumer class actions. Russello joined the Law360 Securities Editorial Advisory Board in 2017.

During his tenure at the Firm, Russello has played an integral role in litigating securities class actions whose successful resolution has returned millions of dollars to aggrieved investors, including those of Blackstone ($85 million); NBTY, Inc. ($16 million settlement); LaBranche & Co., Inc. ($13 million settlement); The Children’s Place Retail Stores, Inc. ($12 million settlement); Prestige Brands Holdings, Inc. ($11 million settlement); Jarden Corporation ($8 million settlement); and TNS, Inc. ($3.6 million settlement).  He continues to prosecute securities class actions on behalf of individual and institutional investors and is involved in several active cases.

Russello has also been instrumental in achieving exceptional results for investors in corporate takeover and breach of fiduciary duty class action litigation.  For example, in expedited litigation in the Delaware Court of Chancery involving Mat Five LLC, a Citigroup Inc.-sponsored municipal bond hedge fund, his efforts paved the way for an “opt-out” settlement that offered investors more than $38 million in increased cash benefits – far above that which investors could have received under the terms of the original transaction. 

More recently, Russello played an integral role in convincing the Delaware Court of Chancery to enjoin Oracle Corporation’s $1 billion acquisition of Art Technology Group, Inc., pending the disclosure of material information to shareholders that exposed the full extent of the preexisting relationship between the acquirer and the target company’s financial advisor. This result is credited with having engendered a renewed emphasis on the importance of complete and accurate disclosure to shareholders of actual and potential conflicts of interest faced by corporate advisors in the context of merger transactions.

Additionally, Russello has experience in litigating shareholder derivative cases and actions seeking the production of corporate books and records. He continues to represent investors in these kinds of actions while maintaining an active roster of shareholder class action merger cases.

Russello also litigates high-stakes commercial matters and consumer class actions. For example, he has prosecuted fraud and other claims arising out of investments in structured financial products and instruments, such as collateralized debt obligations and credit default swaps. He also represents clients in complex breach of contract actions, and has litigated claims arising out of the alleged breach of distribution, marketing and franchise agreements. Finally, Russello litigates consumer class actions, and, in one such case, played a significant role in prosecuting claims of first impression arising under New York’s automatic renewal statutes.

Prior to joining the Firm, Russello practiced in the professional liability group at Rivkin Radler LLP, where he principally defended attorneys, accountants and other professionals in state and federal litigation and assisted in evaluating and resolving complex insurance coverage matters. Russello began his career at a boutique litigation firm based in New York, where he prosecuted and defended a wide variety of matters on behalf of state agencies, municipalities, corporations and individuals.

Russello earned a Bachelor of Arts degree in Philosophy, with honors, from Gettysburg College. He received his Juris Doctor degree from Hofstra University School of Law.
