Robbins Geller Obtains Settlement in Dog Treat Class Action Case
On June 23, 2015, United States District Judge Robert W. Gettleman of the Northern District of Illinois granted final approval of a settlement in Adkins v. Nestle Purina PetCare Company, et al., No. 12-cv-2871 (N.D. Ill.); Gandara v. Nestle Purina PetCare Company, et al., No. 13-cv-4159 (N.D. Ill.); and Matin v. Nestle Purina PetCare Company, et al., No. 13-cv-1512 (N.D. Ill.). The settlement resolves claims alleging that Waggin’ Train and Canyon Creek Ranch brand dog treat products imported from China were defective and caused pets to become sick and/or die after consuming the products.
The settlement creates a settlement fund of $6,500,000 and establishes procedures that permit consumers to submit claims for monetary relief. The settlement also requires Nestle Purina to undertake enhanced quality assurance measures and modify certain language on the packaging of its dog treat products.
Robbins Geller is co-lead counsel for the class, and attorneys Stuart A. Davidson and Rachel L. Jensen were principally involved in the prosecution of the case and obtaining this settlement on behalf of the class.
