The Third Circuit held that claims filed for violation of §10(b) of the Securities Exchange Act of 1934 were timely, adopting investors’ argument that because scienter is a critical element of the claims, the time for filing them cannot begin to run until the defendants’ fraudulent state of mind should be apparent.
