Pirraglia v. Novell, Inc.

The Tenth Circuit upheld investors’ accounting-fraud claims, holding that plaintiffs could not be expected to plead details of documents from defendants’ files, that the materiality of defendants’ false statements is usually not resolvable at the pleading stage, and that the absence of insider trading by individual defendants did not mean they lacked a motive to commit fraud.
