Settlement with Defendants in Kleiman v. RHI Entertainment, Inc., et al.

The parties have reached a settlement of this action, pending in the United States District Court for the Southern District of New York, which provides for the payment of $2,500,000 for the benefit of eligible class members.  Plaintiff alleged that Defendants violated the federal securities laws by making false and misleading statements in RHI Entertainment’s registration statement and prospectus for its initial public offering, by failing to disclose that, among other things, at the time of the initial public offering, there was a significant decline in demand for the Company’s made-for-television movies and miniseries, which would adversely affect its licensing fees.  On December 10, 2010, RHI Entertainment and certain of its affiliates filed a voluntary petition for relief under Chapter 11 of Title 11 of the United States Bankruptcy Code.  The proposed settlement has been preliminarily approved by the Court.

The Court has scheduled a final approval hearing for October 25, 2011, at 2:30 p.m.  You are required to submit a claim form by no later than November 21, 2011 in order to participate in the settlement.
